Land can be assigned to private individuals, Turkmen and foreign legal entities, as well as international organizations and foreign states in accordance with the legislation of Turkmenistan.

All land in Turkmenistan, with the exception of land plots in private ownership by citizens, are owned by the state.

Use of land

Land can be assigned to private individuals, Turkmen and foreign legal entities, as well as international organizations and foreign states in accordance with the legislation of Turkmenistan.

Citizens of Turkmenistan who have expressed a desire to receive a land plot must submit an application to the following state bodies that are responsible for the considered land plot:

a) for private ownership - for maintaining a personal part-time household, to irrigate land and construct individual house, - to village, a district etrap in the city;

b) for tenure - to the appropriate state body for land management;

c) for rent:

  • agricultural land - to a village or another agricultural enterprise;
  • for non-agricultural purposes - to the appropriate state body for land management.

Legal entities of Turkmenistan in need of land for tenure or lease, file a petition to the relevant state bodies for land management that are responsible for the considered land plot.

In the applications of citizens and petitions of legal entities of Turkmenistan for the provision of land, the purpose, size and location of the requested land plot must be indicated along with the documents confirming the need for the provision of land.

The procedure for initiating and considering applications of citizens and petitions of legal entities of Turkmenistan on the provision of ownership, tenure and rental of land is defined by the Cabinet of Ministers of Turkmenistan.

Citizens and legal entities of foreign states, as well as international organizations and foreign states that have expressed a desire to receive land for lease, submit a relevant petition to the Cabinet of Ministers of Turkmenistan.

Allocation of land to Turkmen families for maintaining a private part-time household, to irrigate land and construct individual house, is carried out in accordance with the directives of the district administration (city) and Ashgabat.

Documents on the provision of land with the issuance of documents certifying ownership of land, land tenure and lease of land for non-agricultural purposes are defined by the state body for land management in accordance with the legislation of Turkmenistan. Local branches of the State Registration Service for Rights to Real Estate and Related Transactions, under the Ministry of Justice of Turkmenistan, carry out the registration of these documents.

Forms of land use

  • land plots may be granted for ownership, tenure and lease;
  • a land plot may be granted to citizens of Turkmenistan;
  • a land plot can be granted to citizens and legal entities of Turkmenistan for permanent or temporary (up to 99 years) use;
  • a land plot can be leased to individuals, legal entities of Turkmenistan and foreign states, as well as to foreign states and international organizations.
