Legal Significance of Turkmenistan’s Consumer Protection Law and Its Scope
The consumer has the right to free choice of goods (work, services).

The Law of Turkmenistan On Consumer Protection is based on the Constitution of Turkmenistan, the Civil Code of Turkmenistan and consists of this Law and other regulatory legal acts of Turkmenistan. The law regulates the relations arising from a contract of retail sale of goods, an agreement on the performance of work that result in the creation (production) of goods, an agreement on the provision of services that result in the change of the properties and characteristics of the goods (thing), and other agreements aimed at satisfaction of personal (domestic) needs and not related to profit.

State policy in the field of consumer protection

State policy in the field of consumer protection is aimed at:

  • protecting the rights and legitimate interests of consumers;
  • improving the legal framework related to the protection of consumer rights;
  • providing consumers with goods (work, services) of appropriate quality.

Consumer right to free choice of goods (work, services)

1. The consumer has the right to free choice of goods (work, services).

2. The seller (contractor) is obligated to provide the consumer with a free choice of goods (work, services) of appropriate quality at a convenient time for the consumer.

3. The terms of the contract shall be deemed invalid if they limit the consumer rights established by this Law and other regulatory legal acts of Turkmenistan in the field of consumer protection.

4. It is not allowed to condition the purchase of one product (work, service) by the obligatory purchase of another product (work, service).

5. Unless otherwise provided by the terms of the contract, the seller, the contractor is not entitled without the consent of the consumer o:

1) perform (provide) additional work (service) for a fee. The consumer has the right to refuse to pay for the specified work (service), and if it is paid, he has the right to demand from the seller, the executor, a refund of the sum of money paid for the performed (rendered) additional work (service);

2) require full or partial advance payment for the goods (work, service) that the consumer intends to buy.

6. The establishment of any advantages, direct or indirect restrictions when choosing a product (work, service) is not allowed, with the exception of cases provided for by the legislation of Turkmenistan.

7. Certain categories of consumers may be granted privileges and advantages in trade, consumer services and other types of consumer services in the manner established by the legislation of Turkmenistan.

The consumer's right to receive goods (work, services) in a timely manner

The consumer has the right to receive goods (work, services) within the time period established by the contract.
