Turkmenistan’s new Administrative Procedure Code was published on November 4, 2020 in Türkmenistan newspaper. President of Turkmenistan Gurbaguly Berdimuhamedov signed the Law on approval and enforcement of Administrative Procedure Code of Turkmenistan on October 24 this year.
The new Code establishes the procedure for legal proceedings in disputes arising from public legal relations, procedural principles and rules for the consideration and resolution of these disputes in court.
The main tasks of the administrative process are to ensure the rule of law, the rights and freedoms of individuals and the legitimate interests of legal entities in relations with administrative bodies, protection of violated or contested rights and freedoms of individuals, legal interests of legal entities in the field of public legal relations, assistance in strengthening the rule of law and prevention of offenses in the field of public legal relations.
According to the document, the administrative process is carried out on the principles of legality, equality of all before the law and the court, independence of judges, discretion, inquisition, openness, competition and equality of parties, oral proceedings in court.
The new Administrative Procedure Code of Turkmenistan will enter into force on July 1, 2021.
