In accordance with Articles 38 and 39 of the Law of Turkmenistan on Notaries and Notarial Activity, the amount of fees for notarial acts by private notaries in Turkmenistan and the procedure for their collection were approved, according to the Ministry of Justice of Turkmenistan.
The amount of fees for the performance of notarial acts by private notaries and the procedure for their collection were approved by the Decree of the Ministry of Justice of Turkmenistan № 34 dated July 24, 2023.
According to the Decree, from January 1, 2025, tariffs for the certification of transactions related to the transfer and pledge of immovable property, provided for by paragraph 1 of Part 1 of Article 45 of the Law of Turkmenistan on Notaries and Notarial Activity, approved by the Ministry of Justice in accordance with paragraph 2 of Part 1, and for the performance of notarial acts specified in paragraphs 2, 3, 4 and 5 should be applied.
In addition, the Deputy Minister of Justice S.Jumayev and the heads of Justice Ministry departments of provinces, Justice Department of Arkadag city and the State Notary Agency of Ashgabat city were made responsible for monitoring the implementation of the Decision.
A fee is charged for the performance of notarial acts by private notaries, legal consultations on the issues of performing notarial acts, making copies of documents, other legal and technical services. The fee is indicated on each notarized document and is transferred to the special bank account of the private notary.
