Article 348 of the Customs Code of Turkmenistan defines controlled delivery of goods crossing the customs border as an operational investigative activity. This activity permits the importation into Turkmenistan, exportation from it, or movement within its territory of 191 goods, with the knowledge and under the control of the authorities conducting operational investigative activities.
In the movement of goods across the customs border, authorities carry out controlled delivery to prevent, detect, suppress, and investigate crimes related to the illegal circulation of goods.
Authorities carry out controlled delivery of goods in agreement with the customs authorities. The authorized state body in the field of customs and the state body conducting operational investigative activities determine the procedure for this agreement.
In cases where authorities decide to conduct a controlled delivery of goods being exported from the customs territory of Turkmenistan based on an international treaty or in agreement with the competent authorities of foreign states, they do not initiate a criminal case in Turkmenistan. The head of the authority conducting the controlled delivery promptly informs the Prosecutor General of Turkmenistan about the decision made.
