Turkmenistan Approves Procedure For Determining Number, Work Scope of Notaries

The procedure for determining the number of notaries in the country and the scope of their work has been approved in accordance with Article 36 of the Law of Turkmenistan “On Notaries and Notarial Activities”, according to the Ministry of Justice of Turkmenistan.

The procedure for determining the number of notaries and the scope of work was approved by the Order of the Minister of Justice of Turkmenistan No. 41 dated July 26, 2023.

According to this procedure, the number of notaries and the volume of work of state notary institutions are determined by the Ministry of Justice of Turkmenistan based on the boundaries of the administrative-territorial division of Turkmenistan, the number of notarial acts performed, the population and settlements remote from the state notary office.

In addition, the duties of private notaries are determined based on the number of notarial acts, the population and the boundaries of settlements remote from the state notary's office.

According to the approved procedure, based on the number of notarial acts performed by notaries over the past 3 years, one private notary is determined for 300-400 notarial acts per month, one private notary – for 30 thousand inhabitants in the cities of Ashgabat, Arkadag and cities of regional centers, one private notary – for 25 thousand inhabitants in cities with the district status, one private notary – for 20 thousand inhabitants in districts. In addition, a private notary may work on the border of settlements remote from the state notary's office.

The volume of work of private notaries is determined by the Ministry of Justice of Turkmenistan within the administrative-territorial division of Turkmenistan.

Earlier, Turkmenistan approved the amount of fees for notarial acts by private notaries in Turkmenistan and the procedure for their collection.
