Patents of Kazakh Entrepreneurs to Be Valid in Turkmenistan
A regional patent of Kazakhstan will expand opportunities for the domestic producers oriented to the Eurasian market.

The regional patent of Kazakhstan will be valid in eight member states of the Eurasian patent system, ORIENT news outlet reported on Wednesday citing a statement by the Minister of Justice of Kazakhstan Marat Beketayev.

“As a result of the ratification of the protocol, a patent for an industrial design of Kazakhstani commodity producers can be valid in eight member states of the Eurasian patenting system: Armenia, Azerbaijan, Belarus, Kyrgyzstan, Kazakhstan, Russia, Tajikistan and Turkmenistan, thereby making it possible to establish one date priority in all the listed countries," said Beketayev.

According to the Minister, A regional patent will expand opportunities for the domestic producers oriented to the Eurasian market.

“With international patenting, a significant administrative barrier is the need to submit separate applications and pay separate fees in each state,” Justice Minister Beketayev continued. “The advantage of the regional system for Kazakh applicants is the ability to apply to the Eurasian Patent Organization for simultaneous protection of industrial designs on the territory of eight states.”

Eurasian patent system provides a uniform application procedure for physical and legal persons to protect their inventions on the basis of a single Eurasian patent valid in the territory of nine States party to the Eurasian Patent Convention, signed on September 9, 1994.

The Protocol on the Protection of Industrial Designs to the Eurasian Patent Convention was adopted at a Diplomatic conference in Nur-Sultan on September 9, 2019. This is a fundamental document for the creation of a Eurasian system of legal protection for industrial designs.
