In accordance with the Law of Turkmenistan on Licensing Certain Types of Activities, the state-owned enterprises established on the basis of a decision of the Cabinet of Ministers of Turkmenistan and provisions approved by the Cabinet, which provide for the relevant types of activities, can carry out these types of activities without a license.
In accordance with the law, the following entities also have the right to carry out activities without a license in the territory of Turkmenistan:
- state-owned enterprises that are part of the licensing authority that licenses the relevant types of activities that carry out these types of activities;
- entities carrying out activities in accordance with the established procedure on the territory of the free economic zone (national tourist zone, etc.), provided that the specified activity is limited to the territory of this zone and (or) is carried out on the terms of a concession agreement;
- joint educational institutions established in accordance with the established procedure on the basis of an international treaty of Turkmenistan or a decision of the Cabinet of Ministers of Turkmenistan, as well as educational institutions carrying out activities in the field of education and professional training through their branches, having a permit (license) of a foreign state to carry out this activity in the territory Turkmenistan, as well as educational institutions of foreign states.
The entities specified in the first part of this article are obliged to comply with the licensing requirements and conditions established by the relevant licensing regulations.
License - a special permit to carry out, in accordance with the Civil Code of Turkmenistan, a licensed type of entrepreneurial activity and activities in the provision of professional services, issued to the licensee by the licensing authority, subject to mandatory compliance with licensing requirements and conditions.
