Customs Code of Turkmenistan, Its Economic and Legal Significance
Goods and vehicles crossing the customs border of Turkmenistan shall be subject to customs clearance and customs control in accordance with the procedure and under the conditions stipulated by the Customs Code.

The Customs Code defines the legal, economic and organizational foundations for the state regulation of the customs activities, which contributes to the development of the economy of Turkmenistan and ensuring its economic security.

Customs in Turkmenistan is a set of methods and means of customs regulation of issues related to the movement of goods and vehicles across the customs border of Turkmenistan, determining the procedure and conditions for customs clearance, application of customs regimes, collection of customs payments, customs control and other measures for implementing the customs policy of Turkmenistan.

Customs legislation of Turkmenistan

The customs legislation of Turkmenistan is based on the Constitution of Turkmenistan and consists of the Customs Code of Turkmenistan and other normative legal acts of Turkmenistan that regulate relations in the field of customs.

If an international treaty of Turkmenistan establishes rules other than those contained in the Customs Code of Turkmenistan, then the rules of the international treaty shall apply.

Customs clearance and customs control

Goods and vehicles crossing the customs border of Turkmenistan shall be subject to customs clearance and customs control in accordance with the procedure and under the conditions stipulated by the Customs Code.

When carrying out customs clearance and customs control, the customs authority and its officials may not impose requirements and restrictions not stipulated by the customs legislation of Turkmenistan and other normative legal acts of Turkmenistan.

Information on regulatory legal acts in the field of customs

The authorized state body in the field of customs affairs and other customs bodies shall ensure free-of-charge access to the information on normative legal acts in the field of customs affairs including the use of information technologies.

The authorized state body in the area of customs shall ensure publication of normative legal acts in the area of customs affairs adopted by this body in periodic publications.

On additions and amendments to the Customs Code of Turkmenistan

On April 17, 2022, the following additions and changes were made to the Customs Code of Turkmenistan, approved by the Law of Turkmenistan dated April 17, 2022:

The amendments were made to the relevant words in articles 7, 37, 38, 100, 209, 244, 322. The articles 39, 40, 46,48,49 were also amended. And also after Article 731, Article 732 was added, Articles 83, 159, 214 were amended accordingly, after Articles 359, 359 were supplemented with Chapter 41 (including Articles 3591, 3592, 3593, 3594).

The additions and amendments were published in Neytralnyi Turkmenistan newspaper’s issue No. 100 (30133) of 20.04.2022.
