What Is Procedure For Granting Annual Primary Leave in Turkmenistan?

According to Article 87 of the Labour Code of Turkmenistan, the procedure for granting annual primary leave in Turkmenistan is as follows:

1. Annual primary leave should be provided to the employee every year. The employer must notify the employee of the start of the annual primary leave no later than fifteen days before its commencement.

2. The right to receive annual primary leave within the first year of employment arises after eleven months of continuous work from the date of conclusion of the employment contract.

3. Annual primary leave before the completion of eleven months of continuous work should be granted at the request of the employee:

  • To a woman before or after her maternity leave;
  • To a person with a disability;
  • To a minor;
  • To an employee who has been released from their previous job due to staff reduction, liquidation of the enterprise, or termination of activity by the employer (individual);
  • To an employee working part-time, unpaid leave is granted simultaneously with the annual primary leave of their central place of work;
  • To an employee transferred by order of a higher authority to another job within the system of one ministry or department, the annual primary leave is granted for the actual working time in that system.

4. Annual primary leave for the second and subsequent years of employment is provided following the established vacation schedule at the enterprise.

5. For educational workers of all types, the annual primary leave is usually granted during the summer holidays, regardless of the time of their employment in the respective educational institution.

6. Annual primary leave during the summer or other convenient time should be provided upon request to:

  • A woman with two or more children under the age of fourteen (or under the age of eighteen if the child has a disability);
  • A single parent or a person replacing them, raising one or more children under the age of fourteen (or under the age of eighteen if the child has a disability);
  • The wife of a conscripted military serviceman who has one child;
  • A person with a disability;
  • A minor;
  • A person who adopted (or fostered) children under the age of three;
  • A person who suffered as a result of a radiation catastrophe.

7. The provision of annual primary leave during the summer or other convenient times to specific categories of veterans is regulated following the procedures established by the legislation of Turkmenistan.
