Land plot in Turkmenistan

Under Article 16 of the Land Code of Turkmenistan, land plots are granted to individuals, legal entities of Turkmenistan and foreign states, as well as to foreign states and international organizations, as follows:

1. Citizens of Turkmenistan seeking to obtain a land plot submit an application at the location of the land plot:

a. For ownership — for personal subsidiary farming (household plots) and individual housing construction — to the gengesh or the hyakimlik of the etrap or city;

b. For use — to the relevant state authority for land resources management;

c. For lease:

  • irrigated land — to a daikhan association or another agricultural enterprise;
  • land for non-agricultural purposes — to the relevant state authority for land resources management.

2. Legal entities of Turkmenistan requiring land for use or lease submit a petition to the relevant state authority for land resources management at the location of the land plot.

3. Applications by citizens and petitions by legal entities of Turkmenistan for the granting of land must specify the intended purpose, size and location of the requested land plot and must be accompanied by documents substantiating the need for the land.

4. The procedure for initiating and reviewing applications by citizens and petitions by legal entities of Turkmenistan for granting land ownership, use and lease is determined by the Cabinet of Ministers of Turkmenistan.

5. Citizens and legal entities of foreign states, as well as foreign states and international organizations seeking to lease land submit a petition to the Cabinet of Ministers of Turkmenistan.

6. The granting of land plots to citizens and legal entities of Turkmenistan, the leasing of land for non-agricultural purposes, and the transfer of land into private ownership to families of Turkmen citizens for individual housing construction are carried out on the basis of a decision by the State Land Commission.

7. The transfer of land plots to families of Turkmen citizens for personal subsidiary farming (household plots) is carried out in accordance with a decision of the hyakimlik of the etrap or city.

8. The preparation of documents for granting land plots, including the issuance of documents certifying land ownership, land-use rights and lease rights for non-agricultural purposes, is carried out by the state authority for land resources management in accordance with the legislation of Turkmenistan. State registration of these rights is conducted by the territorial bodies of the Service for State Registration of Rights to Immovable Property and Transactions Related Thereto under the Ministry of Adalat of Turkmenistan.
