Under Article 24 of the Law of Turkmenistan on Notaries and Notarial Activities, notaries are required to:
- Perform their professional duties following this Law and the Oath adopted;
- Comply with professional ethics;
- To perform notarial acts in compliance with the requirements of this Law and other legal acts;
- To assist individuals and legal entities in exercising their rights and protecting their legal interests, to explain to them their rights and obligations;
- To warn the applicants of the legal consequences of the notarial acts being carried out;
- keep confidential the information that became known to them in connection with the implementation of notarial activity;
- submit the information on the notarial acts performed, other documents, and personal explanations to the relevant authorities which consider complaints about their actions;
- Submit to the authorized body for combating money laundering, financing of terrorism, and financing weapons of mass destruction proliferation the necessary information following the legislation of Turkmenistan;
- Inform the relevant tax authorities about property transferred to citizens by way of inheritance;
- Refuse to carry out notarial acts that do not comply with the law;
- In the case of obtaining a notary's license, to insure his/her professional liability;
- Comply with the licensing requirements and conditions of private notaries;
- Execute other duties stipulated by the legislation of Turkmenistan.
Submission of information on notarial acts to the authorized body for combating the legalization of proceeds of crime, financing of terrorism, and financing of proliferation of weapons of mass destruction in the manner prescribed by the legislation of Turkmenistan shall not constitute the disclosure of the secret of notarial acts.
